Withholding tax of dividend paid on nominee registered shareholders
Finland adopted the so-called OECD TRACE -model (Treaty Relief and Compliance Enhancement model) concerning the withholding taxation of dividends paid to nominee registered shares from the beginning of 2021. The Treaty benefit can be granted at the time of payment of the dividends, but under much stricter conditions. In general withholding tax of 35 % will be withheld from dividend payment made on foreign nominee registered shares. If the custodians are registered as so-called Authorized Intermediaries in Finland and they are able to provide sufficient information as specified by the Finnish Tax Administration, lower withholding tax can be applied for the dividend. If the nominee registered non-resident shareholder is eligible for a lower withholding tax rate based on a double taxation treaty, but a higher withholding tax is levied on the dividend, the excess can be reclaimed by submitting a refund application to the Finnish Tax Administration. Additional information can be found fromFinnish Tax Administration www-page.
